LIABILITY WAIVER

I hereby acknowledge and agree that participation in training, programs, and events conducted by Heated involves inherent risks, including but not limited to accidents, injuries, illnesses, or death. Such risks may include, but are not limited to, falls, contact with other participants, the effects of a heated or cold room during workouts, and other risks associated with physical activity in such environments. I knowingly and voluntarily assume all such risks.

I further acknowledge my/our responsibility to communicate any physical, psychological, or medical conditions that may affect my ability to safely participate in activities offered by Heated. I affirm that I am physically fit and mentally capable of engaging in the activities I choose to participate in and understand that participation is entirely voluntary.

In consideration of being allowed to participate in training, programs, and events provided by Heated Haleiwa, I, for myself and on behalf of my heirs, executors, administrators, assigns, and legal representatives, hereby:

1. Release, Waive, and Discharge Heated, its owners, officers, directors, employees, agents, representatives, organizers, and successors (collectively referred to as "Released Parties") from any and all liability, claims, demands, causes of action, or expenses of any kind arising out of or related to my participation in Heated's activities, including but not limited to any injury, illness, damage, or loss that I may suffer or sustain, whether arising from negligence or otherwise.

2. Hold Harmless and Indemnify the Released Parties from any claims, demands, or legal actions brought against them by myself or third parties as a result of my participation in Heated's activities.

3. Understand and Acknowledge that this waiver and release is intended to be as broad and inclusive as permitted by the laws of the State of Hawaii and agree that if any portion of this waiver and release is held invalid, the remaining portions shall remain in full force and effect.

By accepting these terms and conditions, I affirm that I have read and fully understand this Liability Waiver and Release of Claims. I understand that by signing this document, I am waiving substantial legal rights, including the right to sue the Released Parties. I voluntarily agree to these terms and conditions as a condition of my participation in Heated's activities.

TERMS & CONDITIONS

Heated is not responsible in any way for the safekeeping of your personal belongings while attending a class. By attending classes, events, activities, and other programs and using Heated studio facilities, website, or equipment, you hereby acknowledge on behalf of yourself, your heirs, personal representatives, and/or assigns, that there are certain inherent risks and dangers in the strenuous nature of a workout program. You acknowledge that you have voluntarily chosen to participate in a program of intense physical exercise in a group class setting. You acknowledge that Heated Haleiwa strongly recommends that you consult with your physician prior to commencing any class. You also acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. 

All members must be at least 18 years of age and sign the Heated release form to book and attend in-studio classes. A parent or legal guardian may accompany a 16 or 17-year-old minor to attend in-studio class if the adult member agrees to sign the appropriate release forms for the minor. Minors under the age of 16 may not enter or use Heated facilities at any time, no exceptions. No pets are allowed on premises at any time, no exceptions. At all times, you shall comply with all stated and customary terms, COVID policies, rules, and verbal instructions given to you by your instructor. Our ultimate goal is to provide a safe environment for everyone!

PURCHASE POLICY

Classes and instructor assignments are subject to change without notice. Heated is not liable for any dissatisfaction arising from such changes. By accepting our member agreement, you acknowledge and accept this policy. Pricing is subject to change without notice. All sales are final for all class credits, class packages, monthly memberships, and gift card purchases. No guest bookings are permitted; the guest booking feature is disabled on our website and Heated App. All class packages are non-transferable and non-refundable; there are no exceptions. The expiration date will be noted on the credit package or membership during purchase and will also be featured on your member profile. Heated Haleiwa will not be held liable for any bank overdraft fees. We reserve the right, to refuse service.

MONTHLY MEMBER CANCELLATION & FREEZE POLICY

Monthly Memberships require an initial commitment of 3 consecutive monthly payments for the 25-class membership and an initial 4 consecutive monthly payments for the 10-class membership, without the option to freeze or cancel. No exceptions will be made. After making 3 initial consecutive monthly payments for the Heated Haleiwa 25-Class Monthly or 4 initial consecutive monthly payments for the Heated 10-Class Monthly, the membership will automatically renew indefinitely until terminated. You may cancel or freeze the monthly membership agreement with written notice to Heated at least seven days prior to your next scheduled payment date, without incurring any additional fees or penalties. Monthly Memberships allow for a maximum of two non-medical emergency freezes per year, not exceeding a total of 2 months, after the initial 3-month or 4-month period. Freezes do not adjust or extend the auto-pay schedule. Any unused classes do not roll over and are not transferable. Freezing a membership preserves the amount of time between the freeze start date and the next billing period. Therefore if it is 10 days until the next billing date and the membership is frozen for a month, the customer will be billed 10 days after the Freeze End Date.

CLASS ATTENDANCE POLICY

We kindly request all participants to arrive at least 5 minutes prior to the scheduled class start time. These crucial minutes before class are dedicated to finalizing the class list, arranging everyone's starting spots, accommodating waitlisted individuals, and ensuring a prompt start for an uninterrupted workout session. Please note that if you arrive late, waitlisted members will be given your spot in class, the studio doors will be locked, and it will be considered a no-show.

For changes or cancellations, please ensure that you cancel the class on the Heated website or app via your member profile at least 12-hours prior to the class start time to retain your class credit. We do not manage cancellations on behalf of participants. Canceling the class after the 12-hour booking window will result in the loss of class credit and a $20 + tax fee for no-shows or late cancellations. 

WAITLIST POLICY

The waitlist is an automatic system, if and when another member cancels a reservation, the system will automatically add the first person on the waitlist into class.  You will be notified via email if and when you’ve made it off the waitlist.  The latest you’d be notified you’ve made it off the waitlist is 2 hours prior to the class start time.

If you're on a waitlist and don't make it into class your credit will be returned to your account 1 hour after the class ends.

If you sign up for multiple waitlists and make it into multiple classes our standard late cancellation policy does apply.
